Terms and Conditions – Tim Whistler Plumbing, Gas Fitting, HVAC, and Electrical
- Scope of Terms and Conditions
The Terms and Conditions of product sales and service projects are limited to those contained herein. Any additional or different terms or conditions in any form delivered by you (“Customer”) are deemed to be material alterations, and notice of objection to them and rejection of them is hereby given. By accepting delivery of the products or by engaging Tim Whistler Plumbing, Gas Fitting, HVAC, and Electrical (“Seller”) to provide product(s) or perform or produce any services, Customer agrees to be bound by and accepts these Terms and Conditions unless Customer and Seller have signed a separate agreement, in which case that agreement will govern. These Terms and Conditions constitute a binding contract between Customer and Seller.
Customer accepts these Terms and Conditions by making a purchase from, placing an order with, or engaging Seller to perform or procure any services. These Terms and Conditions are subject to change without prior notice, except that the Terms and Conditions posted on Seller’s website at the time Customer signs the Installation Proposal will govern, unless otherwise agreed in writing by Seller and Customer.
- Payment Terms
Customer shall pay Seller according to the terms in the Installation Proposal. Final payment shall be due after the work described in the Installation Proposal is substantially completed. - Zoning and Permits
Customer agrees to timely provide all information necessary to secure plans and permits for the work called for under this Agreement, and warrants the work contracted for to be in compliance with applicable zoning, classification, and building codes. Any costs for work not in the Estimate but required by lawful authorities to bring the work into compliance shall be the Customer’s responsibility. Seller assumes no responsibility for violation of zoning rules/laws. - Change Orders
During the progress of the work, if Customer orders extra work not specified in the Agreement, Seller may require the extra work to be considered a separate agreement and may require payment in advance. - Work Schedule
Work shall be completed within a reasonable time. Performance is subject to strikes, fires, acts of war or terrorism, acts of God, weather conditions not reasonably anticipated, transportation delays, Seller’s ability to obtain materials, and/or causes beyond Seller’s control. - Substitutions
If Seller is unable to obtain any material(s) specified, Seller may substitute comparable materials at its sole discretion without affecting the Contract Price. - Excess Materials
Extra materials left over after completion are Seller’s property. Seller may enter the premises at reasonable hours to remove them. - Supervision Responsibility
Seller shall supervise and direct the work using reasonable skill and attention. Customer shall not interfere with Seller’s workforces or subcontractors. - Limited Warranty
Seller shall provide a limited warranty on service and labor as set forth in the Installation Agreement. Warranty limitations, exclusions, and conditions follow the same structure as previously stated, including no liability for wear and tear, misuse, weather damage, condensation, or manufacturer defects. Manufacturer warranties, if any, will be assigned to the Customer without recourse. - Design Conditions
All equipment will be designed and installed based on industry-standard Manual J load calculations unless Customer declines such testing. If Customer declines, Seller is not responsible for oversizing or undersizing issues. - Performance or Condition of Existing Equipment
Seller is not responsible for the performance or compatibility of existing systems not replaced during installation. - Existing Line Set
Seller is not responsible for problems due to existing line sets that cannot pass required testing unless replaced. - Existing Gas Pipe
Seller is not responsible for the condition of existing inaccessible gas piping; additional repairs may be billed separately. - Paint, Patchwork, and Repairs
Seller is not responsible for painting, patchwork, or repairs following installation. - Personal Property
Seller is not responsible for damage to Customer’s personal property near the work area. - Existing Attic Access Stairs
If attic stairs are unsafe or inadequate for equipment installation, alternate methods may be required at Customer’s expense. - Mold
Seller is not responsible for mold discovery or removal. Work may be suspended until remediation is complete. - Insurance and Waiver of Subrogation
Customer shall maintain adequate property insurance for the full value of the structure and all work. - Indemnification
Customer shall indemnify and hold harmless Seller against claims except those caused by Seller’s sole negligence or intentional misconduct. - Risk of Loss
Risk of loss passes to Customer upon delivery of materials to the property. - Severability
If any provision is unenforceable, the remainder shall remain valid. - Performance
If Customer fails to meet obligations, Seller may terminate with notice while retaining payment rights. - Collections
Late payments are subject to a 2% monthly (24% annual) charge. Collection costs, including attorney’s fees, will be borne by Customer. - Entire Agreement
This Agreement constitutes the entire agreement between Customer and Seller. - Right to Cancel
Customer may cancel within three (3) business days after signing. - SMS Policy
